Heard learned counsel for the petitioner and learned Standing Counsel for State respondents.
The present petition has been preferred by the petitioner for the following relief:-
"(a) issue a writ order or direction in the nature of mandamus commanding / directing the respondent no.2 (District Magistrate Kannauj) to provide all the fresh document of the petitioner agricultural ancestral land vide old Khata No.40 &45 in Fasli year 1384 to 1386 and vide Aakar Patra-23 (Ch-23), Khata No. 43 (Annexure No.1 & 2 to the writ petition) situated in Village-Barua Sabalpur, Tehsil-Chhibramau, District Kannauj.
"(b) issue a writ order or direction in the nature of mandamus directing / commanding the respondent no.3 to deliver the possession of the petitioner agricultural land in accordance with the fresh record of old Khata No. 40 & 45 and Aakar Patra- 23 (Ch-23) (Annexure No.1 & 2 to the writ petition).
(c) Issue a writ order or direction in the nature of mandamus directing / commanding the respondent no.3 to decide the petitioner's last representation dated 14.12.2020 (Annexure No.7 to the writ petition)".
Learned Standing Counsel fairly states that in case the representation dated 14.12.2020 is still pending and has not been decided, the same will be considered and decided expeditiously.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the writ petition stands disposed of with observation that in case the petitioner makes fresh representation to respondent no.3 ventilating his grievance within two weeks, the authority would decide the same in accordance with law in further six weeks.
The party shall file computer generated copy of such order downloaded from the official website of High Court Allahabad, self attested by the petitioner along with a self attested identity proof of the said person (preferably Aadhar Card) mentioning the mobile number to which the said Aadhar Card is linked.
The concerned Court/Authority/Official shall verify the authenticity of such computerized copy of the order from the official website of High Court Allahabad and shall make a declaration of such verification in writing.
