THE HON’BLE SRI JUSTICE S.RAVI KUMAR SECOND APPEAL NO.825 OF 2009 JUDGMENT:
This Second Appeal is preferred against the Judgment dated 23-3-2009 in A.S.No.10 of 2007 on the file of Senior Civil Judge, Parvatipuram.
Heard the Advocate for the appellants and perused the material papers and the grounds mentioned in the grounds of appeal as substantial question of law.
All the grounds referred in the headings substantial question of law are factual aspects and those aspects were already considered by the Courts below with regard to share and symbolic delivery and also about the maintainability of the suit.
On perusal of the material, I do not find any substantial question of law that is involved in this appeal, which requires a decision from this Court.
For these reasons, the Second Appeal is dismissed as no substantial question of law is involved in this Second Appeal. No order as to costs. The Miscellaneous Petitions pending if any shall stand closed.
