Heard learned counsel for the petitioner.
Present writ petition has been filed seeking a direction to the Additional District Judge, Court No. 9, Jhansi to expedite the hearing of Misc. Civil Appeal/F.A.F.O. being No. 532 of 2017, under Section 104 read with Order XLIII Rule 1 (r) CPC, 1908 within a stipulated period.
Submission is that the appeal is pending since 2017 and during the pendency of the appeal the defendants are selling out the property and therefore, the appeal should be decided at the earliest.
In the facts and circumstances of the case, the present writ petition is finally disposed of with the direction to the to expedite the hearing of the aforesaid appeal and decide the same on its own merit, in accordance with law, expeditiously, preferably within a period of eight months, provided there is no legal impediment and no unnecessary adjournments shall be granted to the parties.
With the aforesaid observations/ directions, the present writ petition is finally disposed of.
