JUDGMENT / ORDER

Heard the learned counsel appearing for the petitioner and the learned counsel appearing for the respondent.
2. This writ petition has been filed praying for a writ of Mandamus to direct the respondent to dispose of the petitioner's application, dated 29.4.2009, seeking for affiliation for the course of Diploma in Nautical Science (1 year course) leading to B.Sc. (Nautical Science).
3. It has been submitted that the petitioner Academy had been established in the month of April, 2000, after complying with all the statutory requirements and formalities. The petitioner Academy has been awarded with ISO 9001-2000 Certificate for Quality Training by Indian Register of Quality System.
4. The petitioner Academy has been granted affiliation to conduct the course in B.Sc. (Marine Engineering) and B.Sc. (Nautical Science). The petitioner had requested the respondent to grant affiliation for Diploma in Nautical Science (1 year course) leading to B.Sc. (Nautical Science) and B.E. (Naval Architecture & Ocean Engineering)  4 year course.
5. It has also been stated that there is no disqualification for the grant of affiliation for the said courses. The Inspection Committee of the respondent had favourably recommended for the grant of provisional affiliation to the petitioner academy for conducting the said courses. The petitioner has submitted an application, dated 29.4.2009, seeking for affiliation for the said courses and the respondent had not disposed of the same till date. In such circumstances, the petitioner has preferred the present writ petition before this Court, under Article 226 of the Constitution of India.
6. At this stage of the hearing of the writ petition, the learned counsel appearing for the petitioner had submitted that this Court may be pleased to direct the respondent to dispose of the application, dated 29.4.2009, filed by the petitioner, within a specified time.
7. The learned counsel appearing for the respondent has no objection for this Court passing such an order.
8. In view of the submissions made by the learned counsels appearing for the parties concerned, without going into the merits of the case, the respondent is directed to consider and pass appropriate orders on the application of the petitioner, dated 29.4.2009, on merits and in accordance with law, within a period of ten days from the date of receipt of a copy of this order.
9. With the above directions, the writ petition stands disposed of. No costs.
