Heard Sri Sandeep Arora, learned counsel for the petitioner, Sri Krishna Mohan Asthana, learned counsel for the respondent no.1 and Sri Brijesh Kumar Kushwaha, learned counsel appearing for respondent nos. 5.
Present writ petition has been filed for issuance of mandamus commanding the respondent no.1-Recovery Officer, Debt Recovery Tribunal, Allahabad to decide the petitioner's application dated 8.9.2020 in D.R.C. Case No. 442 of 2018 for attachment of movable and immovable property of the judgment debtor.
It is submitted by learned counsel for the petitioner that the order was reserved by Recovery Officer on 9.12.2020 but the order has not been delivered on the said application.
Learned counsel appearing on behalf of respondents admitted the said position and submits that they have no objection, if specific direction be issued.
Under these circumstances, this petition stands disposed of with the direction to the respondent no.1-Recovery Officer, Debt Recovery Tribunal, Allahabad to decide to decide the petitioner's application dated 8.9.2020 or deliver the order on the said application filed in D.R.C. Case No. 442 of 2018 as expeditiously as possible, preferably within a period of one month from the date of production of copy of this order.
The party shall file computer generated copy of such order downloaded from the official website of High Court Allahabad, self attested by the petitioner alongwith a self attested identity proof of the said person (preferably Aadhar Card) mentioning the mobile number to which the said Aadhar Card is linked.
The concerned Court/Authority/Official shall verify the authenticity of such computerized copy of the order from the official website of High Court Allahabad and shall make a declaration of such verification in writing.
