JUDGMENT / ORDER

Dhananjay Awasthi, learned counsel, accepted notice on behalf of respondent who may file counter affidavit within one month. Petitioner will have two weeks thereafter to file rejoinder affidavit.
The contention raised by the petitioner is that in the notice dated 11.07.2007, a liability of the interest and damages was fixed to the tune of Rs. 95,000/-. The petitioner raised an objection, that is still pending consideration before the authority concerned, but now a liability of Rs.34,30,233/- has been fixed upon the petitioner by the notice dated 16.03.2009 (Annexure No.18 to the writ petition ). The submission of the petitioner is that within a span of three years the interest and damages cannot be enhanced to exorbitantly In the facts and circumstances of the case, it is provided that in case the petitioner deposits a sum of Rs.1,00,000/- (one lakh) before the concerned authority within a period of two weeks, then further recovery proceedings in pursuance of the order impugned shall remain stayed till further orders of this court.
