Heard Sri Pankaj Agarwal, learned counsel for the petitioners and learned Standing Counsel for the State-respondents.
Sri Pankaj Agarwal, learned counsel for the petitioners submits that an application for granting recognition to the petitioner no. 2, H.P.G. Girls Inter College, Sahibabad, Ghaziabad (hereinafter referred to as the "Institution") as a girls inter college, is pending before the respondent authorities. An inspection has also been conducted in that regard. However, no finding decision has been taken on the claim of recognition to the Institution as a girls inter college. The petitioners have made a representation in this regard.
Learned Standing Counsel for the State-respondents submits that the matter is factual in nature and the facts have to be verified by the competent authority.
No useful purpose will be served by keeping the writ petition pending. The writ petition is being disposed of finally with the consent of the parties.
The matter is remitted back to the respondent no. 2, Regional Secretary, Intermediate Education Board, Regional Office, Meerut.
A mandamus is issued to the respondent no. 2 directing him to decide the representation of the petitioner for grant of recognition to the petitioner Institution as a girls inter college expeditiously as possible preferably within a period of six months from the date of receipt of a certified copy of this order.
The respondent no. 2 shall ensure that the due diligence exercise including physical inspection, checking of the credentials of the teachers and the staff, the infrastructure in the Institution and all other relevant criteria for the purposes of grant of recognition is conducted. Upon consideration of relevant criteria, the respondent no. 2 shall pass a reasoned and speaking order in the matter in accordance with law.
It is clarified that this Court has not judged merits of the claim of the petitioners or the veracity of the submissions made in the writ petition. It is for the competent authority to do so after independent application of mind upon all the relevant criteria.
The writ petition is disposed of finally.
