Heard learned counsel for the petitioner; the learned A.G.A. for the respondents 1, 2 and 3; and perused the record.
The instant petition seeks quashing of the first information report dated 16.12.2020 registered as Case Crime No. 135 of 2020 at P.S. Panwara, District- Jaunpur, under Sections 323, 504 IPC and Sections 3(1)(Da) & 3(1)(Dha) of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.
The allegation in the impugned first information report is in respect of insulting/abusing/assaulting the informant's husband, who is a member of scheduled caste.
On 23.03.2021, learned A.G.A. was required to seek instructions whether there is any medical report of the informant's husband.
Learned A.G.A. has informed the Court that there is a medical examination report of the informant's husband which reveals that he has suffered simple injuries.
In view of the above, prayer of the petitioner to quash the first information report cannot be accepted.
The petition is dismissed without prejudice to the right of the petitioner to apply for bail.
