Inland vs Liquidator

(Per : HONOURABLE MR.JUSTICE P.B.MAJMUDAR) Learned advocate for the applicant is not present when called out. Even on the last occasion also the learned counsel for the applicant was not present.

Mr.Desai, learned counsel for the Official Liquidator, submits that applicant has already filed Civil Suit and leave is not required to be granted to him for filing Appeal against the impugned order.

Since the applicant has already filed substantive Civil Suit, in our view, present Civil Application is not required to be entertained. Hence, the Civil Application is rejected.
