ORDER: (Per the Hon’ble The Chief Justice Sri Kalyan Jyoti Sengupta)
We are of the view that taking advantage of inability of the learned Tribunal to decide the mater within a period of thirty days, the respondent authorities, on the strength of the notification, have started taking coercive measures. This particular notification was examined by this Court.
However, the learned counsel for the parties is unable to produce the judgment rendered by this Court on an identical matter on which they have placed reliance. We therefore direct the learned Tribunal to decide the matter on merit within a period of thirty days from the date of communication of this order. In the meantime, the respondent authorities are restrained from taking any coercive measures.
The writ petition is accordingly disposed of. There will be no order as to costs.
Miscellaneous petitions, if any, pending in this writ petition shall stand disposed of.
