JUDGMENT / ORDER

1. So far as the relief prayed for by the applicant bank is concerned, the application has been disposed of vide order dated 3.2.2012. However, by virtue of another order of even date the office has been directed to continue to list present matter on separate / special cause list so that the other inter connected issues can be separately addressed and appropriate direction can be passed.
2. In this context it is necessary to mention that during the hearing of present Company Application No.348 of 2011 learned advocate for the applicant bank made grievance that the office of OL is not attending the hearing of any application or any motion before the Debt Recovery Tribunal and the hearing of any application is neither being attended nor orders are being complied with. Under the circumstances, by different orders passed during the hearing of present application certain details were called for from the office of OL and subsequently Mr. Yadav, learned advocate for the OL was asked to file his report, in his capacity as panel advocate for the OL, to suggest appropriate alternatives so that the said grievance can be effectively addressed. He has filed the report date 3.2.2012.
3. It is also brought to the notice of the Court that OL is in the process of preparing - expanding the panel of advocates and once the said process concluded then it would be possible for OL to assign advocate for attending the matters in Tribunals and other Courts.
4. Therefore, until the said process is concluded the OL is directed to file appropriate report within period of 10 days after finalizing (upon considering the experience and other relevant aspects) the names of the advocates who are willing to appear in the proceedings on behalf of OL before the Debt Recovery Tribunal, Railway Tribunal, Labour Court, Civil Court and other fora where the OL is required to prosecute or defend the proceedings. After such list is finalized the OL shall immediately seek sanction of the Court to engage services of the advocates. In the report OL shall also mention the professional fees to be paid to the advocates. Such report shall be filed within two weeks from today.
5. So as to await the said report, the hearing of present application is adjourned to 16.3.2012.
