JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE JAYANT PATEL) The basis of the present petition is the order passed by the learned Single Judge of this Court dated 06.09.2010 in Special Civil Application No.5254/05, whereby the direction was given to pay the gratuity and pension.
Upon hearing the learned counsel appearing for both the sides, it appears that it is an undisputed position that pending the petition, arrears of the pension has been paid and the gratuity amount is also paid.
However, Mr.Sejpal, learned counsel appearing for the applicant states that as on account of the revision of 6th pay commission, pension will have to be revised and arrears will have to be paid by the respondent and regular pension based on the same is also required to be paid.
Learned AGP under the instructions of Mr.P.P. Chandla, Deputy Accountant, states that necessary action for revision of pension as per 6th pay commission shall be completed within two weeks and the difference shall also be paid within two weeks thereafter and monthly pension in any case will be paid in regular course.
We direct the respondents to comply with the declaration made.
In view of the above, the cause of the petitioner will not survive. Disposed of accordingly. Liberty to apply in case of difficulty.
