In pursuance of the order dated 5.9.2014 Shri Ajay K. Singh Bhadauriya has passed on instructions dated 16.9.2014 which mentions that a sum of Rs. 13,10,000/- has been paid to the petitioner and for the rest of the amount the matter has been referred to Dy. Chief Accounts Officer, Lucknow. However, the order further indicates that 300 days leave encashment amounting to Rs.7,08,600/- has not been paid. Out of Provident Fund Rs. 17,60,000/- only Rs. 13,10,000/- has been paid. Out of the gratuity amount of Rs. 10 lacs Rs. 9,50,000/- has been sanctioned but not paid and for the remaining Rs. 50,000/- the matter has been referred to the Bareilly Division for payment. So far as commutation of pension is concerned it is stated that 40% of the pension Rs. 6,96,752/- has to be paid by Vidyut Vitaran Khan-I Hardoi but the same has not been paid. A recovery has to be made from the month of July and August, 2014. In paragraph 5 of the instructions it is stated that a sum of Rs. 3,543/- towards D.A. from the month of January, 2014 alongwith arrears of the VI Pay Commission had been submitted to the Dy. Chief Accounts Officer, Lucknow but the same has been returned due to some error pointed out therein. It is further mentioned in paragraph 6 that ex-gratia amount of Rs. 3,454/- has been submitted to the Dy. Chief Accounts Officer, Lucknow. But all these amounts have not been paid except a sum of Rs. 13,10,000/-.
Put up on 24.9.2014, on which date Dy. Chief Accounts Officer Lucknow shall appear before this Court to explain as to why the payments are not being made to the petitioner when the same are admitted and there is no dispute about the same. He shall also indicate the amount of interest which became due on the late payment of retiral dues.
