HONOURABLE MR.JUSTICE AKIL KURESHI) Counsel for the petitioner submitted that even after the Tribunal allowed the petitioner s appeal by an order dated 29.10.2012, respondents have failed to refund the amount of Rs.2.20 crores deposited by the petitioner by way of pre-deposit pending the appeal before the Tribunal. The petitioner has already written letters to the respondents requesting for such amount to be refunded. No action is taken though, as per CBEC directives, such refund should be paid within 3 months. To the best of the petitioner s knowledge, no appeal is filed against the decision of the Tribunal.
Issue notice returnable on 25.4.2013.
Direct service to respondents No.2 and 3 is permitted.
