Heard learned counsel for the petitioners and the learned Standing counsel.
The petitioners have agreed for purchase of a property from private respondents no. 3 to 7 and have allegedly paid the sale consideration but after execution of the sale deed, respondents failed to get it registered.
Accordingly, petitioners moved application under Section 73 of The Registration Act, 1908 before the Registrar/Sub-Registrar. The said application has been registered bearing number D 20140520000853 and is pending since 22.8.2014.
The petitioners want that the aforesaid application be decided within a time bound period.
In view of the aforesaid facts and circumstances, as the application is pending for the last 5 years and the Registrar/Sub- Registrar is obliged to decide the same in accordance with the provisions of Chapter XII of the Act, we dispose of the petition with the direction to the Registrar/Sub-Registrar of District Deoria to consider the above application of the petitioners most expeditiously preferably within a period of three months from the date a copy of this order is produced before him.
In considering the above application the Registrar/Sub- Registrar would consider the maintainability of the application itself.
The writ petition is disposed of.
