… RESPONDENTS THESE WRIT PETITIONS ARE FILED UNDER ARTICLES 226 & 227 OF THE CONSTITUTION OF INDIA, PRAYING TO DIRECT R-1 TO TRANSFER THE INVESTIGATION OF CHIT FUND SCAM FROM MAHADEVPURA POLICE TO CID / COD IN WHICH THE PETITIONERS HAVE LOST THEIR HARD EARNED MONEY & ETC.
THESE WRIT PETITIONS COMING ON FOR PRELIMINARY HEARING IN ‘B’ GROUP THIS DAY, THE COURT MADE THE FOLLOWING:-
ORDER Mr.Sunil Kumar H., learned counsel for the petitioners.
Mr.Vijay Kumar A.Patil, learned counsel for the respondents.
2. The writ petitions are admitted for hearing.
With consent of the learned counsel for the parties, the same is heard finally.
2. In these petitions, the petitioner is seeking for a writ of mandamus directing respondent No.1 to transfer the investigation of Chit Fund Scam from Mahadevpura Police to CID/COD in which the petitioners have lost their hard earned money.
3. When the matters were taken up today, learned counsel for the petitioner submitted that the he be granted with a liberty to make a fresh representation with regard to his grievance raised in the petition before the competent authority. On the other hand, learned counsel for respondent submitted that if such a representation is made by the petitioner the same shall be dealt with in accordance with law.
4. In view of the submissions made and in the facts of the case, the writ petitions are disposed of with a liberty to the petitioners that in case a representation is made to the competent authority, the same shall be decided by the competent authority within a period of six weeks from the date of receipt of such a representation. It is made clear that this Court has not expressed any opinion on the merits of the case.
Accordingly, the petitions are disposed of.
