JUDGMENT / ORDER

RULE.
Learned APP Mr. H.L. Jani waives service of Rule on behalf of respondent No.1 and learned advocate Ms. Sneha Joshi waives service of Rule on behalf of respondent No.2.
This Revision Application is directed against the judgment and order dated 26.11.2007 passed by the learned Judicial Magistrate First Class, Modasa in Criminal Case no.180 of 2004, whereby the applicant was ordered to suffer S.I. for 15 months for the offence punishable under Sections 138 and 139 of the Negotiable Instruments Act and also ordered to pay the amount stated in the complainant towards compensation amount to the complainant. Said judgment and order was confirmed by the learned Additional Sessions Judge, Sabarkantha District, at Modasa.
Learned advocate Mr. Saurabh Patel for the applicant submitted that as directed by this Court, the applicant has deposited Rs.1,75,000/- before the lower Court. He produced the receipts showing deposit of the amount. Said receipts are ordered to be taken on record. He submitted that time to surrender by the applicant before the Jail Authority is extended upto today. He prayed to grant bail to the applicant.
Heard learned advocate Mr. Sneha Joshi for the original complainant and learned APP Mr. H.L. Jani for the State.
Perused the application along with papers and considered the submissions made by the learned advocates for the parties. The applicant has deposited Rs.1,75,000/- before the lower Court and therefore, I am of the view that till final disposal of the Revision, the applicant is to be released on bail.
In view of above, applicant is ordered to be released on same bail with fresh bond. Direct service is permitted today.
