JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE AKIL KURESHI) The applicant complains of non compliance of directions of the Division Bench contained in its order dated 19.4.2011 passed in Civil Application No.2600/2011. As per the said order, respondents were to pay revised daily wage at the rate of Rs.350/- to the applicant with effect from 1.10.2008 till further orders. Such directions were to be complied with latest by end of May 2011. Since this was not done, present contempt application came to be moved by five workmen who were not paid according to the said interim order.
Learned counsel Ms. Sejal Bhatt appearing for respondents stated that above mentioned order of Division Bench was carried in appeal before the Apex Court. She placed on record an order dated 31.1.2012 passed by the Apex Court. Upon perusal of the said order, it emerges that Apex Court while desiring that Letters Patent Appeal be heard expeditiously did not interfere with the interim order passed by the Bench. The Court however, extended the time for compliance of order by a period of four weeks. Learned counsel for the respondents stated that respondents shall comply with the interim order of the Learned Single Judge within the time permitted by the Apex Court.
In view of the above developments, this contempt petition is disposed of with liberty to apply in case of difficulty.
