Heard learned counsel for the petitioner and learned standing counsel for State- respondents.
Present petition has been filed with following relief;
"I) Issue a writ, order or direction in the mandamus commanding the respondent no. 2 to decide the representation dated 02.02.2018 submitted by the present petitioner before him within a short period as fixed by the Hon'ble Court.
II) Issue a writ, order or direction in the nature of mandamus commanding the respondent no. 2 to provide the salary during the suspension period from 16.10.2001 to 26.06.2002 to the petitioner."
Learned counsel for the petitioner submits that a suitable direction may be issued to respondent no. 2 to consider the representation of the petitioner dated 02.02.2018 and decide the same within stipulated time to which learned Standing Counsel has no objection.
Under such facts and circumstances, this petition is disposed of with direction to respondent no. 2 to consider the representation of the petitioner dated 02.02.2018 and decide the same strictly in accordance with law maximum within a period of eight weeks from the date of production of computer generated copy of the order. Petitioner is directed to annex the photocopy of the representation along with computer generated copy of this order.
It is made clear that Court has not adjudicated the case on merits and it is upon the respondent no. 2 to decide the representation of the petitioner after considering the Act, Rules, Government Orders, Judicial pronouncement made by the Court as well as facts of the case.
