Supplementary affidavit filed today is taken on record.
Heard Sri B.P. Mishra, learned counsel for the petitioner and Sri Ashutosh Dwivedi, Advocate holding brief of Sri Rahul Chaturvdi, learned counsel for the respondents-Bank.
The writ petition has been filed challenging the recovery citation dated 18.2.2014 issued by the respondent no.3 amounting to Rs.1,02,199 + collection charges + interest (Annexure-1).
Though, the matter has remained pending for seven years, there is no interim order. Also, no recovery has been made from the petitioner, in the meanwhile. At this stage, learned counsel for the petitioner prays for indulgence to discharge the entire amount in installments.
The prayer for the installments has not been opposed by the respondent-corporation.
Accordingly, the writ petition is disposed of with a direction that in case, the petitioner deposits an amount of Rs.52,199/- on or before 30 September 2021 and satisfies the entire balance amount within a period of two months in two equal installments each of Rs.25,000/- payable on or before 31 October 2021 and 30 November 2021, respectively, no coercive measure shall be adopted against the petitioner pursuant to the recovery citation dated 18.2.2014 issued by the respondent no.3.
On depositing the entire amount, the petitioner may apply for restoration of the connection, on payment of usual charges.
In case of default of the conditions as mentioned above, the present order shall stand automatically vacated and recovery proceedings shall revive from that stage.
