Hon'ble Alok Mathur,J.
1. Heard learned counsel for the petitioner as well as learned Standing Counsel for the State respondents.
2. Learned counsel for petitioner submits that inadvertently the State has not been made party and seeks permission to made Stated as respondent.
3. Accordingly, the prayer is allowed.
4. Learned counsel for petitioner is directed to make Assistant Collector, Tehsil Koraom District Prayagraj as respondent No. 10 forthwith.
5. In view of the order proposed to be passed, requirement of issuance of notice to respondent nos. 1 to 9 are hereby dispensed with. Notice on behalf of respondent No. 10 has been received by learned Standing Counsel.
6. Instant petition has been filed by the petitioner praying for direction to the Assistant Collector Tehsil Karaon, district Allahabda/Prayagraj to decide the partition suit No. T2015020309650 of 2014(T201802030900506) Indramani Vs.
Shiv Darshan and others within a shortest possible period of time.
7. Learned counsel for the petitioner submits that grievance of the petition would be sufficiently met in case respondent No. 10 - Assistant Collector Tehsil Karaon, district Allahabda/Prayagraj, considers and decides the aforesaid case in the time bound manner.
8. Learned Standing Counsel has no objection to the aforesaid prayer.
9. Considering the facts and circumstances of the case, without entering into the merits, respondent No. 10 - Assistant Collector Tehsil Karaon, district Allahabda/Prayagraj, is directed to decide partition suit No. T2015020309650 of 2014(T201802030900506) Indramani Vs. Shiv Darshan and others expeditiously, say within a period of eight months from the date of production of certified copy of this order, in accordance with law, if there is no legal impediment.
10. It is further directed that the parties to the case shall cooperate in expeditious disposal of the case and shall not seek any unnecessary adjournment, neither any such adjournment shall be granted by the Court concerned, except in exceptional circumstances.
11. With above observations/directions, the writ petition stands disposed of.
