Heard learned counsel for the petitioner and learned Standing Counsel.
The petitioner is before this Court for a direction to second respondent to conclude the pending disciplinary proceeding in question against the petitioner within stipulated period.
Learned counsel for the petitioner apprises to the Court that the chargesheet in question has already been responded vide reply dated 26.9.2019 to the second respondent but till date the enquiry in question has not been finalised as yet.
On the other hand, learned Standing Counsel raised an objection that the said reply to the chargesheet is to be served upon the enquiry officer instead of serving to the second respondent.
Confronted with this, learned counsel for the petitioner states that definitely the reply would be submitted to the enquiry officer within one week and the enquiry may be directed to be concluded expeditiously.
Considering the facts and circumstances of the case and with the consent of parties, the writ petition stands disposed of with observation that in case the reply to the chargesheet is given to the enquiry officer within one week, the enquiry officer would definitely finalise the proceeding in question in accordance with law preferably within three months thereafter.
