The sole relief pressed for by the learned counsel for the petitioner at the time of hearing of the writ petition is that the Competent Authority may take a decision for claim of the petitioner for payment of compensation in regard to the land that has been acquired under the provisions of the National Highways Act, 1956 (hereinafter referred to as 'the Act').
It is stated that though the petitioner is entitled to receive compensation, respondent Nos. 6 & 7 have also made a claim as a result of which compensation has not been paid to the petitioner.
Learned Standing Counsel appears for respondent Nos. 1 to 4. Sri Pranjal Mehrotra appears for respondent No. 8. In view of order that is proposed to be passed, it is not necessary to issue notice to respondent Nos. 5, 6 & 7 as they can be heard by the Competent Authority when the application filed by the petitioner is decided.
Learned Standing Counsel states that the application filed by the petitioner shall be decided at an early date after hearing the parties concerned.
This petition is, accordingly, disposed of with a direction to the Competent Authority to take a decision on the application filed by the petitioner after hearing the parties concerned including private respondent Nos. 5, 6 & 7 expeditiously and preferably within a period of three months from the date a certified copy of the order is filed by the petitioner.
It is made clear that the Court has not adjudicated upon the merits of the case and it is for the Competent Authority to take a decision in accordance with law.
