On 14.04.1983 the record of this appeal was summoned for admission after the receipt of the record and on 06.02.1986 leave to appeal was granted. Since then it is pending decision.
This appeal was filed by complainant Indradeo Pandey against acquittal order of the opposite parties in the Criminal Case No. 436 of 1982 under Sections 323, 504, 506 IPC, vide order dated 31.01.1983, passed by the IInd Additional Munsif Magistrate, Ballia.
This Court has been informed that appellant Indradeo Pandey has died and no one is pursuing this appeal after his death. It appears the legal heirs of the appellant after his death has lost interest in this appeal and they do not want to prosecute the opposite parties who have already been acquitted by the impugned order.
On the other hand, the learned AGA appearing on behalf of the State supports the impugned judgment and order. He submits that the impugned order is just and proper and it does not suffer from any illegality or infirmity. The appeal deserves to be dismissed for non prosecution.
Accordingly, this appeal is dismissed for non prosecution.
