Heard Mr. R.B. Maurya, learned counsel for the petitioner. The only prayer made in the writ petition reads thus:
“I. to issue a writ, order or direction in the nature of mandamus commanding the Appellate Authority i.e. respondent no.2 to decide the Appeal filed by the respondent nos. 5 and 6 under section 15(2) of U.P. (Regulation of Building Operations) Act, 1958 (St. Mary's Schools and another Versus Prescribed Authority / Sub Divisional Magistrate, Regulated Area, Mainpuri) against the order dated 04.07.2016 passed by the respondent no.3 in Case No. 14 of 2013 (dated 27.06.2013) in purported exercise of powers under Section 10 of U.P. (Regulation of Building Operations) Act, 1958, pending before him since 2016 within a stipulated period as fix by this Hon'ble Court.”
Admittedly, the petitioner is not a party to the appeal of which he is seeking expeditious hearing by way of the instant writ petition. In view thereof, the petition is dismissed as not maintainable.
