Heard Mr. Birendra Singh, learned counsel for the petitioners and Mr. Hari Nath Tripathi, learned counsel for the respondent- Pollution Control Board.
Though the petitioners have made three prayers in the writ petition, counsel appearing for them submits that he has instructions to press only the second prayer. The second prayer reads thus:
"2. Issue a writ, order or direction in the nature of mandamus commanding and directing the respondents to decide the Form I (Consent Seeking Form) dated 14.3.2018 (Annexure no. 4 to the writ petition)."
Other prayers are disposed of as not pressed.
Counsel appearing for the respondent-Pollution Control Board seeks three months' time to consider and decide the petitioners' application/Consent Seeking Form No. I, dated 14.3.2018, whereby they are seeking consent for emissions/continuation of emission under Section 21 of the Air (Prevention and Control of Pollution) Act, 1981. His submission is recorded and accepted. In view thereof, petition is disposed of with direction to respondent No. 4 to consider and decide the petitioners' application/Consent Seeking Form No. I, as expeditiously as possible and preferably within a period of three months from today. Petitioners are directed to produce a copy of this order alongwith copy of the writ petition and its annexures before the concerned Authority within one week from today.
