Heard learned counsel for the applicants and the learned AGA appearing on behalf of the State through video conferencing.
By means of this application, the applicants have prayed for quashing the impugned non-bailable warrant dated 11.02.2021 in Case Crime No.0134 of 2017, under Sections 379 and 411 IPC at Police Station Raja Ka Rampur, District Etah, Case Crime No.557 of 2018 (State vs. Indra Pal and others) pending before A.C.J.M., Court No.17, Etah whereby non-bailable warrant has been issued against the applicants.
After arguing for while, learned counsel for the applicants do not want to press the relief sought in the application. He submits that the non-bailable warrant has been issued against the applicants by the trial court and the applicants are ready to appear before the trial court, hence, some protection may be granted to them.
Considering the facts and circumstances of the case, it is provided that in case the applicants appear within 30 days of date and apply for recall of the warrant, the same shall be considered and disposed of expeditiously thereafter. Till disposal of the applicants' motion to recall the non-bailable warrant, no coercive steps shall be taken against them.
It is made clear that the applicants will not be granted any further time by this Court for surrendering before the Court below as directed above.
With the aforesaid observations, the present application is disposed of in terms of the above order.
