The present application under Section 482 Cr.P.C. has been filed by the applicants with the prayer to quash the impugned order dated 15.11.2018 passed by Addl. Chief Judicial Magistrate, Court No.1, Bareilly in complaint case no. 268 of 2014 under Sections 17, 18, 19, 20, 21, 22 of Protection of Women from Domestic Violence Act, P.S. Baradari, District Bareilly. Further prayer has been made to stay the further proceedings of the aforesaid complaint case as well as effect and operation of the impugned order.
Heard learned counsel for the applicants and the learned AGA appearing for the State.
No stay order has been passed in the application u/s 482 No. - 8050 of 2015 filed by the applicant. Only counter and rejoinder affidavits were invited. It appears that opposite party no.2 also approached this Court by filing a separate application u/s 482 No.-33534 of 2018 for direction to the court concerned for expeditious disposal of the case. The Magistrate concerned in light of the order passed in that application proceeded to decide the matter expeditiously. Since no stay order has been passed in application u/s 482 No.- 8050 of 2015, order passed by the Magistrate concerned on 15.11.2018 cannot be termed to be illegal. No interference is required in this matter.
Application is accordingly dismissed.
