Heard learned counsel for the petitioner and the learned Standing Counsel appearing for the respondents.
This writ petition has been filed seeking a direction to the respondent no. 2 to take appropriate decision in the matter and complete enquiry against the Village Pradhan in application dated 26.6.2018, filed by the petitioner under Section 95 (1) (g) of U.P. Panchayat Raj (Removal of Pradhan, Up- Pradhan and Members) Enquiry Rules, 1997 within a stipulated time.
Drawing attention to Annexure-4 to the writ petition, submission of learned counsel for the petitioner is that now an application supported by an affidavit has also been filed, which is in accordance with the Rules, therefore, the same is liable to be considered as per law.
Considering the facts and circumstances of this case, without expressing any opinion on the merits of the case, the respondent no. 2, the District Magistrate, District Fatehpur is directed to decide the aforesaid matter, as expeditiously as possible, strictly in accordance with law and the Rules framed under U.P. Panchayat Raj (Removal of Pradhan, Up Pradhan and Members) Enquiry Rules, 1997, within the time prescribed by the Rules.
It is made clear that this Court has not examined the merits of the claim of the petitioner, which shall be considered by the authority concerned on its own merit.
With the aforesaid observations, present writ petition stands disposed of. No costs.
