Heard learned counsel for the applicants and learned AGA for the State.
The present 482 Cr.P.C. application has been filed to quash the entire proceedings in Case Crime No. 197 of 2018, under Sections- 325, 452, 504, 506 IPC, Police Station- Chandauli, District- Chandauli, pending in the court of C.J.M., Chandauli.
Learned counsel for the applicants submits that the applicants have been falsely implicated by the police under the alleged sections. He also submits that the main accused Shyam Narayan has exonerated by the investigating officer and other accused persons have been implicated illegally. No offence is made out against the applicants.
In that view of the matter, they are permitted to move discharge application through counsel before the trial Court within one month from today and the trial court shall decide the same within a period of two month from the date of filing of application alongwith certified copy of this order.
Till the discharge application is decided, no coercive measures shall be taken against the applicants.
With the aforesaid observations, this application is disposed of.
