JUDGMENT / ORDER

The petitioner had submitted application under Section 28(A)(3) seeking for a reference of the award dissatisfied by the order passed under Section 28(A) of the Land Acquisition Act, 1894 (for short, 'the Act'). Exts.P4 and P5 are the representations submitted by the petitioner.
2. The said request for reference has been rejected on the ground that the application is not in proper form.
3. It is not in dispute that the issue is covered by the judgment of this Court in Jameson v. State of Kerala [2006 (3) KLT 186].
4. It is, therefore, clear that even if, the application is not in proper form, the authorities are bound to refer the matter when a request has been made by the claimant under Section 28(A)(3) of the Act.
In the result, this writ petition is disposed of as under.
WP(C) 20029 of 2013 2 The respondent shall refer the award of the petitioner to the appropriate court invoking power under Section 28(A)(3) of the Act. It shall be done within a period of one month from the date of receipt of a copy of this judgment.
