The petitioner has filed this writ petition challenging Ext.P1 award in LAC No.48/12. According to the petitioner, the award has been passed on 3.2.2014. The right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 has come into force on 1.1.2014. Therefore, it is contended that Ext.P1 is unsustainable. 2. I have heard the learned Government Pleader also.
In view of the dictum laid down in Aliyamma Mathai v.
State of Kerala and Others [2014 (3) KHC 808] Ext.P1 cannot be sustained. The same is therefore set aside. The first respondent shall be at liberty to pass further orders in accordance with the provisions of the new Act.
