1. The present Civil Revision Application u/s.115 of the Code of Civil Procedure has been preferred by the applicants herein - original defendant Nos.1 to 3 to quash and set aside the impugned order dated 04/09/2006 passed by the learned 14th Additional Senior Civil Judge, Vadodara below Exh.80 in Special Civil Suit No.42 of 1995.
2. Today when the present Civil Revision application is taken up for final hearing, Mr.Uday Joshi, learned advocate appearing on behalf of the applicants has placed on record the xerox copy of the purshis dated 08/04/2009 submitted by original plaintiff through his advocate, by which, he has requested to permit him to withdraw the suit. Xerox copy of the withdrawal purshis submitted by the original plaintiff is directed to be taken on record.
3. In view of the above, Mr.Uday Joshi, learned advocate appearing on behalf of the applicants seeks permission to withdraw the present Civil Revision Application at this stage with a liberty to revive the present Civil Revision Application in case of difficulty and/or cause survive.
4. In view of the above, the present Civil Revision Application is dismissed as withdrawn at this stage with above liberty. Rule is discharged. Ad-interim relief, if any, stands vacated forthwith.
