JUDGMENT / ORDER

1. Learned advocates for the parties have jointly submitted that their respective client have arrived at a settlement and in terms of that settlement both the parties have agreed to have this matter disposed of.
2. Shri Nirav Joshi for M/s Nanavati Associates under the instructions states at the Bar that the workman shall be paid Rs.2.00 lakhs (Rs. Two lakhs only) against all his claims and as full & final settlement in respect of his claims against the company, and said amount shall be paid on or before 10/7/2012 by account payee cheque or demand draft.
3. Shri Nirav Sanghvi for Mr. Ashish Dagli for the workman states that the workman himself is present in the Court and he identifies him, and under his instructions states that the workman is agreeing to give up all the claims arising out of litigations, including the present one against the company and further states that after receiving Rs.2.00 lakhs as agreed the workman shall have no claim whatsoever against the company.
4. The Court also inquired of the workman Shri Nareshkumar Dhanjibhai Lavda, who says that this settlement is agreeable to him.
5. In view of this, the petition is disposed of with a direction to the parties to abide by the settlement made by their advocate. The award impugned in this petition stands modified to the aforesaid effect and on payment of Rs.2.00 (Rs. Two lakhs only) workman shall have no claim whatsoever against the company. Rule made absolute in above terms of settlement. No order as to costs.
