JUDGMENT / ORDER

1. Learned advocate Shri Ketan Acharya on behalf of the respondent workman has submitted that the respondent workman Shri M.I. Diwan is present in the Court and he has agreed for accepting Rs.2.50 lacs (Rs. Two lacs and fifty thousand only) towards full & final settlement in lieu of the reinstatement and all other claims & dues against the company arising out of the Reference (LCV) No. 1251/1993.
2. Learned advocate Shri Raheel Patel for M/s Nanavati Associates has submitted that he has received instruction from the petitioner company that the matter be settled as the workman has agreed to accept Rs.2.50 lacs.
3. The workman is present in the Court, who has been identified as such by his advocate Shri. Acharya and the Court inquired of the workman, who said that he is agreeing for this settlement. In light of this, the impugned award is modified and now instead of reinstatement the workman's claim would stand satisfied on his receiving Rs.2.50 lacs from the petitioner company within fifteen days, i.e. on / or before 10th September, 2012.
4. The award accordingly stood modified. Petition is disposed of with a liberty to file fresh petition or proceedings in case of difficulty. Rule discharged. Ad- interim relief granted earlier shall stand vacated. However there shall be no order as to costs.
