Sri S.N. Singh has filed his power on behalf of the respondent no.2, the same is taken on record.
Heard learned counsel for the applicants, Sri S.N. Singh, learned counsel for respondent no.2, learned A.G.A. for the State and perused the record of this application.
Applicants claims that mediation process may be drawn at the mediation centre of this Court and the transaction was got selling land of the applicant to O.P. No.2 for which the applicant is making his mind and may be that if negotiation succeeds, then he is ready to sell the land in question to O.P. No.2.
It is directed that applicants shall deposit a sum of Rs.20,000/- within two weeks' from today with the Mediation Centre of which 90% shall be paid to opposite party no.2 for his appearance before the Mediation Centre.
The matter is remitted to the Mediation Centre with the direction that the Mediation Centre shall conclude the mediation and conciliation proceedings expeditiously, preferably within a period of one month after giving notices to both the parties.
Thereafter the case shall be listed before appropriate Bench.
Till the next date of listing, further proceedings of Complaint No.585 of 2018, under Section 138 of the Negotiable Instrument Act, 1881, P.S. Indrapuram, Ghaziabad, pending in the court of Additional Civil Judge, court no.6, Ghaziabad, district Ghaziabad shall remain stayed.
After depositing the amount, aforesaid, notices shall be issued to the parties and in case the aforesaid amount is not deposited within the aforesaid period, this application shall stand dismissed automatically.
