ORDER:
This Company Petition is filed under Sections 433 and 434 of the Companies Act, 1956 (for short "the Act") for winding up the respondent for non-payment of the alleged debt.
The respondent herein is the co-borrower along with the principal borrowers/respondents in C.P.Nos.264 and 265 of 2013. Today, by detailed orders passed in C.P.No.264/2013 and 265/2013, this Court has admitted the said Company Petitions. Therefore, I do not find it appropriate to entertain this Company Petition at this stage. However, liberty is left with the petitioner to file a fresh Company Petition if it could not recover the debts fully from the principal borrowers.
The Company Petition is accordingly dismissed with the liberty given as above.
As a sequel to the dismissal of the Company Petition, Company Application Nos.1276, 1277 and 1293 of 2013 are disposed of as infructuous.
