It is contended on behalf of the petitioner that in similar and identical facts this Court in Writ-C No. 31821 of 2018 (All India Small and Medium News Papers Federation and another v. Union of India and others) vide order dated 28th September, 2018 has issued a direction that the second respondent may consider the cause of the petitioners therein. Learned counsel for the petitioner has produced before us a copy of the said order passed by this Court.
We have heard learned counsel for the petitioner and Sri Dhruv Kant Chaturvedi, learned Advocate, who has put in appearance on behalf of the respondents. With their consent the writ petition is taken on board for final disposal at this stage in terms of the Rules of the Court.
We have gone through the order dated 28th September, 2018 passed by this Court in the aforesaid writ petition. The relevant part of the order reads as under:
"The contention raised by the petitioners is that the application moved before the Director on 31st May, 2017 has not been considered in spite of the fact that the petitioners fulfil the minimum eligibility for such consideration as prayed for in terms of the various advisories issued by the Government of India, Ministry of Information and Broadcasting for print media advertisement.
We find that these are advisories and in such circumstances, there cannot be a grievance of any violation of a fundamental right, but at the same time, if such similar applications in relation to the matters arising out of print media advertisement have been considered by the respondents then in that event the application filed by the petitioners also deserves to be considered and disposed of in accordance with any such advisory that may be prevalent keeping in view the category to which the petitioners belong.
We accordingly grant liberty to the petitioners to approach the respondent no. 2 who may consider the said grievance of the petitioners in accordance with law and pass appropriate orders preferably within three months.
Disposed of."
Having regard to the fact that the parties are not in conflict on the fact that it is a similar matter, we dispose of this writ petition also in terms of the order passed in Writ-C No. 31821 of 2018 (supra), as quoted above.
No order as to costs.
