DELAY CONDONATION & RESTORATION APPLICATIONS This is an application for restoration of the case along with an application seeking condonation of delay in filing the Restoration Application. On 08.07.2010 this Court had passed following order:
"List of old cases has been revised. Neither counsel for the petitioner nor counsel for the respondents is present.
Consequently, present writ petition is dismissed for want of prosecution. Interim order, if any, stands discharged."
To the aforesaid applications moved, no objections have been filed till date. Reason has been disclosed in the affidavit that the case could not be marked, as such nobody could appear when the case was called out, and further request has been made that for the fault of the counsel, the client should not be made to suffer.
Cause shown appears to be sufficient. Delay in filing Restoration Application is condoned; the same is treated to have been filed within time. Since the cause furnished has been found to be sufficient, Restoration application is allowed. Order dated 08.07.2010 is recalled; writ petition is restored to its original number.
