Heard learned Counsel for the petitioner and Sri Gaurav Mahajan, learned Counsel for the department.
The argument of the learned Counsel for the petitioner is that the impugned order has been passed without taking into consideration the directions of this Court while deciding the reassessment proceedings.
Nonetheless, he does not deny the fact that the order itself is appellable. He can take all these objections in appeal.
We are not inclined to interfere in this matter at this stage in view of the decision of Hon'ble Apex Court in the case of Authorized Officer State Bank of Travancore and another vs. Mathew K.C. reported in (2018) 3 Supreme Court Cases 85.
The Writ Petition is disposed of. No costs.
