Learned counsel for the respondents prays that workmen Compensation Commissioner be directed to release 50% of the amount deposited in favour of the claimant/s.
Prayer is allowed. The order dated 2.4.2008 is modified to the extent that the Commissioner concerned shall release 50% of the said sum to the claimant/s in the manner that one half of such sum will be released without security to the claimant/s and another one half will be released upon furnishing security to his satisfaction. However, the balance amount will be kept in a short term Fixed Deposit of a nationalised bank and will be renewed from time to time till the payment is made or till further order/s of the Court, whichever is applicable. The Commissioner concerned is at liberty to keep remaining/balance 50% amount of the total deposited amount in a short term Fixed Deposit of a nationalized bank and will be renewed time to time till the payment is made or till further order/s of the Court, whichever is applicable.
