Learned counsel for the appellant states that Medical Board in its examination has opined that there is 15% disability orthopedically and 30% deformity in the right eye while Commissioner, Workmen's Compensation has taken 100% disability. He submitted that both disabilities are only temporary and not permanent in nature and are curable in a due course.
Prima facie, we find substance in the argument of learned counsel for the appellant.
Admit.
Issue notice to respondent no. 2. The appellant may take steps to serve the respondent by registered post. Sri K.D. Tiwari, Advocate, appears on behalf of claimant-respondent no. 1.
The entire amount of compensation has already been deposited. Until further orders, the Tribunal is directed to release 50% of the amount to the claimant and 50% shall be kept in a fixed deposit scheme in a nationalised bank yielding maximum interest.
