Heard Sri Punit Kumar Gupta for the writ petitioner; learned Standing Counsel for the State-respondents; and Sri Tarun Kumar Agrawal for the U.P. State Election Commission.
By this petition, the petitioner has challenged the election of the respondent as member of Zila Panchayat, Ward No.2, Bilaspur and Swar, District Rampur.
It is not in dispute that the petitioner has an alternative remedy of filing an election petition under U.P. Zila Panchayats (Settlement of Dispute Relating to Membership) Rules, 1994.
In view of the above, the writ petition is dismissed on ground of alternative remedy. It is expected that if the petitioner avails the alternative remedy, the same shall be considered expeditiously in accordance with law.
