Heard Sri Amit Daga, learned counsel for the applicants, Sri Satyendra Narayan Singh, learned counsel for O. P. no.2 and learned A.G.A. for the State.
This application under Section 482 Cr.P.C. has been filed for quashing the entire proceedings in Criminal Case No.1167/9 of 2016 (State Versus Inder Pal & Others) arising out of Case Crime No.170 of 2015 under Sections 498 A, 323 IPC, P. S.Mahila Thana, District-Muzaffarnagar pending in the Court of Chief Judicial Magistate, Muzaffarnagar.
The contention of learned counsel for the applicants is that if the matter is referred to the Mediation Centre of this Court there are bright chances of conciliation between the applicants and O.
P. no.2.
Learned counsel for O. P. no.2 states that charge sheet in this case was submitted in the year 2015 and the trial of the case is going on in which statements of three witnesses have already been recorded, therefore, no useful purpose would be served by referring this matter to the Mediation Centre of this Court. He further states that if the applicants genuinely want to settle the differences and reconcile with O. P. no.2, they may move an appropriate application before the trial Court concerned, which shall decide the same keeping in view the fact that the dispute between the parties is matrimonial one.
In view of aforesaid facts, this application appears to be bereft of merits. The prayer for quashing the entire proceedings of aforesaid case is refused.
With the aforesaid observations this application stands finally disposed of.
