The earlier writ petition of the petitioner being Writ Petition No. 6399 (S/S) of 2001, Indra Pal Singh and another Vs. Chairman & Managing Director, I.T.J. Ltd. and others was disposed of finally vide order dated 31 October 2007 in the following terms;
"The impugned transfer order passed on 18.09.2001 has been challenged in the present writ petition.
No case for interference is made out. However, the respondents shall be at liberty to pass fresh order in accordnace with law after the end of current session.
Subject to above, the writ petition is disposed of finally"
In the circumstances, the petitioner in this writ petition wants that the aforesaid order passed by the High Court be directed to be complied with.
I have heard Sri Inder Pal Singh, the petitioner in person. He clearly states that his only grievance is that the order dated 31.10.2007 is not being complied with and the respondents are not passing any fresh order.
I am afraid that this is not the proper forum where such a prayer can be made or entertained. The petitioner cannot be permitted to file successive writ petitions for the same cause of action or a fresh petition for getting the earlier order of the High Court implemented. In the event, the earlier order of the High Court is not being implemented or followed, the remedy of the petitioner is not by way of a fresh writ petition but otherwise as may be advised to him.
In this view of the matter, the writ petition is wholly misconceived and is, accordingly, dismissed. However, the petitioner may initiate appropriate proceedings as may be advised to him for redressal of his grievance aforesaid.
