JUDGMENT / ORDER

Heard learned counsel for the parties.
The papers transmitted qua the appointment of the petitioner as Class-IV employee in Harjinder Nagar Inter College, Harjinder Nagar, Kanpur Nagar have been returned without approving the appointment on the ground that such appointment has not been made in accordance with the procedure prescribed for selection and constitution of the selection committee under Government Order dated 11.05.2001, as explained under the judgment of the High Court in the case of Principal, Adarsh Inter College, Umari, Bijnor vs. State of U.P. and others; 2010 (1) ADJ 403.
The judgment of the Single Judge, referred to above, has been affirmed by the Division Bench of this Court with the dismissal of the Special Appeal filed against the same.
This Court may record that from the facts stated in the present writ petition it is apparently clear that there was no nominee of the District Magistrate in the selection committee constituted for holding the selection, and therefore there is an admitted violation of the Government Order dated 11.05.2001. The Government Order dated 11.05.2001 specifically provides that unless the selections are held in accordance with the procedure prescribed thereunder, the appointment cannot be approved by the education authorities. In view of the aforesaid, this Court finds that the order passed is strictly in accordance with law and does not warrant any interference. Writ petition is dismissed.
