Heard learned counsel for the petitioner; learned A.G.A. for the respondents 1, 2 and 3; and perused the record.
The instant petition seeks quashing of the first information report dated 23.01.2021 registered as Case Crime No.31 of 2021, under Sections 354(A), 504, 506 IPC; Section 3(1) (R), 3(1)(S), 3(2)(va) of S.C./S.T. Act; and Section 7/8 of Pocso Act, P.S. Bhojpur, District Moradabad.
The allegations in the impugned first information report, inter alia, are in respect of outraging the modesty of minor girl, aged 15 years, and also of insulting her.
Quashing of the first information report has been sought on the ground that the parties have entered into a compromise.
As the victim is a minor and from the record it appears that FIR has also been registered for an offence under the Pocso Act, the prayer of the petitioner to quash the first information report on the basis of a compromise cannot be accepted.
The petition is dismissed without prejudice to the right of the petitioner to apply for bail.
