JUDGMENT / ORDER

Respondent/ Complainant Petition under section 438 of Cr.PC., praying that in the circumstances stated in the memo of grounds filed in Crl.P., the High Court may be pleased to enlarge the petitioner/Accused No. 1 on bail in the event of his arrest in Crime No. 10 of 2014 on the file of the SHO, Women Police Station, Eluru, West Godavari District.
The petition coming on for hearing, upon perusing the Petition and the memo of grounds filed herein, and upon hearing the arguments of Sri M. Karibasaiah, Advocate for the Petitioner, and of the Public Prosecutor for Respondent, the Court made the following.
ORDER:
This Criminal Petition is filed by the petitioner – accused No.1, under Section 438 Cr.P.C, seeking release in the event of his arrest in connection with Crime No.10 of 2014 of Women Police Station, Eluru, West Godavari registered for the offences punishable under Section 498-A IPC and Section 4 of the Dowry Prohibition Act.
The averments in the report are that at the time of marriage, the parents of the informant gave Ac.10.00 of land towards pasupukumkuma, Rs.10.00 lakhs cash, 100 sovereigns of gold, 16 Kgs. of silver and other articles worth Rs.8.00 lakhs. Subsequently, A.1 to A.3 started harassing the informant for an additional dowry of Rs.25.00 lakhs. It is alleged that the accused used to harass her physically and mentally. Basing on the above allegations, the above report came to be lodged.
..2… Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the State.
A perusal of the material available on record would reveal that A.1 filed O.P. No.25 of 2013 in October, 2013 seeking divorce and O.P.No.69 of 2014 seeking return of gold ornaments on 16.12.2013 against the informant. It appears that after receiving notices in the aforesaid O.Ps., the present report was lodged by the informant on 06.03.2014. Omnibus allegations are made against A.1 alleging that he, along with A.2 and A.3, forced the informant to do menial works and made her starve her. A.2 and A.3 were already granted bail. Having regard to the facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioner.
Accordingly, the Criminal Petition is allowed. The petitioner is directed to surrender before the Station House Officer, Women Police Station, Eluru, West Godavari District within a period of ten days from today and on such surrender, he shall be released on bail on his executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties for a likesum to the satisfaction of the same Station House Officer. After his release, the petitioner shall appear before the Station House …3….
Officer, Women Police Station on every Sunday between 9.00 and 6.00 p.m. for a period of four weeks or till the filing of charge sheet whichever is earlier.
