This writ petition was filed upon an apprehension that the Mandal Revenue Officer, Vinjamur Mandal, Nellore District, was proposing to demolish the petitioner’s house situated at D.No.13-139, Vinjamur Panchayat & Mandal, Nellore District. This Court directed status-quo obtaining as on 21.12.2004 to be maintained by the parties by an order of the same date. The said order was extended until further orders on 17.01.2005.
2. While so, the Tahsildar, Vijamur Mandal, filed a counter- affidavit stating that the dwelling house of the petitioner was located in a private patta land and did not come within the purview of any encroachment and as such, demolition of the petitioner’s house did not arise.
3. In the light of this averment, it is clear that the petitioner approached this Court on a mere apprehension. Needless to state, in the event the respondent-authorities propose to proceed against the property of the petitioner, they would have to do so strictly in accordance with due procedure laid down by law.
4. With the above observation, the writ petition is closed. Pending miscellaneous petitions, if any, in this writ petition shall stand closed. No order as to costs.
