Case called out. The learned counsel appearing for the contemnor has moved application seeking exemption of personal appearance of the contemnor in court for today.
It would appear from the record that the matter has been hanging fire since 17.4.2008. It would also appear that the contemnor has made repeated application for exemption from personal appearance on various dates. One of the contemnor has already put in appearance and charges were framed and served to him. In so far as contemnor is concerned, he has been seeking adjournment and exemptions on one ground or the other. It may also be made clear that the Bench is constituted specially for this case as Shailendra Sharma one of the contemnors has already appeared and charges have already been framed against him on 2.12.2009. The matter is ordered to be listed peremptorily on 27.1.2010 on which date it is made clear no further exemption shall be granted and in case, the contemnor again fails to appear before the court, it would be deemed that he has nothing to say and the Court would proceed exparte in the matter as against him.
